The Fixers provides a warranty of two (2) years from the date of purchase on all used Smartphones sold through its network (hereinafter “products”).
The Fixers provides a guarantee for products sold through its network of stores.
The warranty is provided for a period of two (2) years from the date of purchase. It concerns the entire device except the battery which is covered by a one (1) year warranty for defects and not for normal wear and tear. In the event of a defect occurring, in accordance with the terms herein, during the warranty period, the customer has the rights provided below under C. through The Fixers local service points.
a) Defects in consumable parts, such as protective coatings, which are designed to wear out over time.
b) Cosmetic wear including but not limited to nicks, nicks and broken plastic parts or doors.
c) Defects or malfunction due to the use of the product in combination with another product.
d) Defects or malfunction due to accident (eg dropping the product), abuse, misuse, contact with liquid, fire, earthquake or other external cause.
e) Defects or malfunction due to handling of the product contrary to the instructions of the respective manufacturer’s user manual, as stated on the respective manufacturer’s website, technical specifications or other published instructions for the product by the respective manufacturer.
f) Defects or malfunction due to service (including upgrades and extensions) performed by a person not authorized to act on behalf of The.
g) Defects or malfunction resulting from tampering with the product by anyone resulting in altering its functionality or capabilities, without the written permission of The Fixers.
h) Defects due to normal wear and tear due to use or normal aging of the product.
i) If the product has had its serial number removed or obliterated or if the product has been stolen or The Fixers has reasonable grounds to believe that the product has been stolen based on information provided to The Fixers by law enforcement authorities.
In the event of a defect occurring, in accordance with the terms herein, during the warranty period, The Fixers, at its discretion:
(i) will repair the product using new or used replacement parts that are equivalent to new in performance and reliability. or
(ii) will replace the product with a product that is at least functionally equivalent to the product and that is manufactured from new and/or used replacement parts that are equivalent to new in performance and reliability.
In the event that The Fixers repairs the defective product, the following shall apply:
THE PRODUCT HAS CAPABILITIES OF STORING SOFTWARE PROGRAMS, DATA AND OTHER INFORMATION, YOU SHOULD PERIODICLY MAKE BACKUPS OF THE INFORMATION CONTAINED ON THE PRODUCT STORAGE MEDIA TO PROTECT ITS CONTENTS AND AS A MEASURE OF PREVENTION AGAINST POSSIBLE MALFUNCTION.
Before submitting the product for warranty service, you should create separate backup copies of the content stored on the storage medium, remove all personal information, and disable all security passwords. The content on the product’s storage medium may be deleted, replaced and/or reconfigured during service.
After the warranty service work is completed, the product or a replacement product may be returned to you with the configuration that the product had when it was originally purchased and with the appropriate updates, if any. The Fixers may install system software updates as part of warranty service, after which the product cannot be rolled back to an earlier version of the system software. Third-party applications installed on the product may not be compatible or work with the product after the system software update. You are responsible for reinstalling all other software programs, data and information. Recovery and reinstallation of other software programs, data and information are not covered by this warranty.
The Fixers takes no responsibility:

(ii) in case of loss of data contained in the product during the repair of the defective product. In particular:
The Fixers does not warrant, support or promise that it will be able to repair or replace a Product under this warranty without risk to the information and/or data or without loss of information and/or data stored on the Product.
(iii): For any damage (positive or consequential) not caused by a breach of this warranty document by The Fixers.
(iv) for any damage (positive or consequential) which was not, at the time of the purchaser’s purchase of the product, a reasonably foreseeable consequence of The Fixers’ breach of this warranty document or
(v) for any loss (positive or negative) related to any business activity of the buyer, lost profits, loss of data or loss of opportunity.
The terms of the warranty provided by The Fixers are governed exclusively by this document.
No reseller, agent or employee of The Fixers is authorized to modify, extend or add to this warranty.
If any term is found to be illegal or unenforceable, it will be severed from this warranty, without affecting the legality or validity of the remaining terms.
